论环境犯罪伦理品性的嬗变

On the Evolution of Ethical Character of Environmental Crime

环境犯罪虽属行政犯范畴,却具有反伦理道德性。与其他普通犯罪不同的是,环境犯罪不仅违反了社会伦理道德而且还违背了生态伦理道德,同时环境犯罪的伦理品性正在发生着由反社会伦理性向反生态伦理性的嬗变。在此嬗变中,环境犯罪伦理品性的内部非均衡性、环境犯罪客体要件的扩张和环境刑法的本质和目的起着重要的影响作用。

Environmental crime is administrative offense,but has an anti-ethical and moral nature.Different from other ordinary crimes,environmental crime is not only a violation of social ethics,but also against the eco-ethics.At the same time,the ethical character of environmental crime is taking place in the evolution on ethics from anti-social ethics to anti-ecological ethics.The internal non-equilibrium nature of the ethical character,expansion of the object element and essence and purpose of environmental criminal law play an important role in this evolution of environmental crime.
