On Administrative Adjudications in Urban House Demolition

房屋拆迁行政裁决制度已实施了将近十年时间,随着市场经济的进一步发展,城市化的速度愈来愈快,到目前为止,该项制度在理论上及实践中都受到了很大的冲击.房屋拆迁行政裁决制度适合中国国情,能够有效解决拆迁人与被拆迁人就被拆迁房屋的补偿、安置事项所产生的矛盾.经分析认为房屋拆迁行政裁决制度目前主要存在两方面的问题:一是拆迁安置裁决的主体不明确,二是拆迁安置裁决机构的独立性不强.

The House Demolition Administrative Adjudication System has been implemented for nearly a decade, however, up until now, with the further development of the market economy and the increasing pace of urbaniza- tion, it has received great impact both in theory and practice. The author of this paper personally thinks that this system is suitable to China＇s national conditions, and able to effectively solve the contradictions arisen in the compensation of the demolished houses and relocation arrangements between the dismantlers and dismantlees. At the same time, he points out through analysis that the system proves flawed in two main respects： one is the unclarity of the main body for the adjudication of demolishing and relocation; the other is the weak independence of demolition and relocation adjudication institutions.
