法社会学视角的“移风易俗”——聚焦A市殡葬改革

"Transformation of Customs"from Perspective of Legal Sociology——Focusing on Reform of Funeral and Interment in a Certain City

殡葬改革属于自上而下的政府推动型移风易俗,其运行具有反复性、规避性的特点。从法社会学角度看,社会心理因素及基层政权的操作是影响殡葬改革实施效果的主要因素,而制度(建构秩序)与习俗(自发秩序)的对撞与博弈乃是影响殡葬改革成效的主要矛盾。

The reform of funeral and interment begins from the government by transforming the customs.From the perspective of legal sociology, the main factors which affect the reform results are social psychological ones which are influenced by primary political powers.The main conflicts which affect the reform effect are between the system and the customs.
