南非海事优先权制度初探

A Probe into the System of South African Maritime Lien

摘要 海事优先权制度是海商法领域的一项核心制度,也是调整各国海事贸易关系的一项重要制度。南非海事优先权制度具有多元化的法律渊源,但英国法的影响远远大于其他法律。在司法判例中,多项海事优先权纠纷,法院要直接适用英国法处理,这对合宪性是一大挑战。南非海事优先权的范围有不断扩大的趋势,不利于抵押权人和其他债权人利益的实现,也与海事优先权制度的国际发展趋势相背离。由于海事优先权制度识别程序的复杂性,使这一制度认定充满着不确定性。 The maritime lien is one of the core systems of maritime laws and an important system to adjust international maritime trade relations.The South African maritime lien system stems from multiple law systems,among which British law has much more influence on it than the others.It is usually big challenges for the constitution that the courts have to directly use British law to deal with many maritime disputes in respective cases.The confine of South African maritime lien tends to expand more and more,which is not beneficial to the interest of mortgagers and other creditors and is opposite to the tendency of international maritime lien systems.Due to the complexity of the recognition programs of maritime lien,it is usually full of instability.We should have enough knowledge of that in maritime trade with South Africa and take necessary measures to avoid harms so that the interest of Chinese maritime traders can be protected.
