摘要
改革开放以来,随着以市场化为目标取向的经济体制改革的深入和社会主义法治的恢复与发展,中国民法学在服务于改革实践的过程中,不仅获得了繁荣发展,而且也逐渐实现着自身的理论转型。在这一理论转型过程中,中国民法学逐渐摆脱了前苏联社会主义民法学的影响,积极吸收大陆法系传统私法理论的素养,并借鉴某些英美法的因素,初步形成了以私法理念为基础的民法学理论体系。
Chinese civil law has experienced prosperity and development as well as theoretical transition in its serving to the reform practice while the market-targeted economic system reform has been deepened and the socialist rule of law has been recovered and developed since the beginning of the Reform and Opening-up. In this transition, based on private law concept the theory system of Chinese civil law came into being, which has got out of the influence by former Soviet Union socialist civil law in absorbing the essence of the traditional civil law theory of continental law and benefiting from Anglo-American law.
