中国古代司法审判中“刑讯”现象的文化机理探究

Research on Cultural Mechanisms of the "Torture" in Justice in Ancient Chinese Society

在中国古代社会的司法审判中,刑讯是一种惯常现象。这一现象构筑了古代刑罚文化的特征之一,也是现今社会刑讯逼供现象的遗传基因之一。文章认为,中国古代社会的肉刑刑罚遗风、工具主义刑法观、重权力轻权利观念、"无讼"思想等对这一现象的存在起了重要作用。对刑讯现象的文化机理进行探究,有助于正确认识古代的刑讯及当今刑讯现象的分析、矫正、预防。

The judicial trial in ancient Chinese society, torture is a normal phenomenon. The phenomenon structures characteristics of the ancient euhure of punishment, but also it is one of genetic of tor- ture in modern society. According to the article, China＇s ancient legacy of corporal punishment, instrumental view of criminal law, pay more attention to the power than the right, the thought of no dispute, such as the existence of this phenomenon played an important role. To explore the cultur- al mechanism of the phenomenon of torture will contribute correctly understanding of the phe- nomenon of torture in ancient Chinese society and make for analysis, correction, prevention the phenomenon of torture in today＇s society.
