司法官遴选制度比较研究——兼论中国司法官遴选制度的构建

Comparative Study on the Selection Systems of Judicial Officers:on the Construction to Select Judicial Officers in China

现代法治国家一般建立严格的司法官遴选制度,确立司法官职业一体化、专业化和精英化原则,实现司法官逐级晋升制,是司法官遴选制度通用规则。有三种各具特色的司法官遴选模式。我国可在司法官遴选制度比较研究基础上,构建中国司法官遴选制度。

A modern legal state usually requires common criteria for the selection of judicial officers,i.e.the establishment of strict selection system,the establishment of principles of integration,specialization and elitist for its profession and the promotion system by stages.There are three distinctive modes of judicial selection.On the basis of the comparative analysis on the system of selection of judicial officers,assumption of construction of system of selection of judicial officer in China is put forward.
