运动员申诉权问题研究

Appeal rights of Chinese athletes

当对国家体育行政机关、全国单项体育协会、竞赛组织委员会等体育行政主管部门的处罚不服时,依据宪法和其他法律规定,运动员有权向上级行政部门或者有关国家机关申诉。然而,我国运动员在运用申诉权以保障其合法权益的实际操作中却遭遇诸多法制困境。对运动员行使申诉权所存问题进行法理分析,提出完善体育法律规范、建立体育仲裁与诉讼制度、拓展运动员申诉路径等立法建议。

According to the Constitution and other laws,the athletes,who are unsatisfied with the punishment from the head of departments,such as State Administration of Sports,State Association of Single Sport,Competition Commission,have the right to appeal to superior executive departments or other state organs concerned.However,the Chinese athletes are often faced with legal difficulties in appealing for their rights.In this paper,based on a jurisprudential analysis of the existing problems in appeal rights of the Chinese athletes,the author put forward suggestions for establishing legitimate rights and interest protection,and for providing more ways for the athletes＇ appeal.
