不纯正不作为义务来源的反思与重构

Reconsidering and Reconstruction on Act Duty in the Non-typical Omission Offense

从传统的形式论,到引入的实质论,再到融合后的二元论,不纯正不作为的义务来源理论发展到了一个新的阶段。目前的二元论存在不少问题。重构后的二元论应当包括表现形式与产生根据两个方面。表现形式不应当考虑事实性因素,且应当是一种开放式的结构;产生依据同样不应考虑事实性要素,作为义务的实质产生根据是对法益的社会功能关系;两者之间的关系应当是以产生根据为主,以表现形式为辅。

From the traditional Formal Theory to the Substantial Theory to the combined Binary Theory,the Theory of the Source of Act Duty in Non-typical Omission Offense has developed to a new stage.There are many problems existing in present Binary Theory.The reconstructed Binary Theory includes manifestation forms and output bases.The relationship between the two aspects is that output bases are the main part and manifestation forms are the auxiliary.
