摘要
本文在对公共借阅权的意义和各国立法实践分析的基础上,给出了公共借阅权的概念;建议将公共借阅权纳入我国著作权法中,将版权保护中心作为补偿金的管理机构,并提出了公共借阅权的权利主体、补偿金的计算方式、补偿金给付方式等一系列具体制度设计。
Based on the analysis of theory and legislation in various countries of public lending right,the article puts forward the concept of the public lending right. It makes suggestions that bringing public lending right into the copyright law of our country,taking the copyright protection center as the administrative institution in charge of fund of compensation. Meanwhile,the article puts forward the system design of the right subject,the method of calculation of compensation and payment method.
