我国农村土地征用过程中地方政府责任探析

ON THE RESPONSIBILITIES OF LOCAL GOVERNMENT IN LAND EXPROPRIATION

形成于计划经济时代的我国土地征用制度在当前市场经济条件下,存在着明显的制度缺陷,导致各级政府利用制度缺陷滥征、滥用农村土地。近年来各级政府对农村土地的征用量急剧增大,征地中严重损害农村集体组织及失地农民利益,引发了政府与失地农民的紧张关系,影响社会稳定。对作为制度执行者的政府在具体的土地征用过程存在的行政失范行为进行了探讨与研究,以期规范政府土地征用的行为。

In the present condition of market economy,the land expropriation system originated in the era of planned economy has evident defects in the system and is liable to result in the indiscriminate expropriating and use of rural land because government at all levels take advantage of the defects in the system,seriously doing harm to the interests of the peasants and the rural collective organizations,which causes the conflicts between the peasants and government and influences social stability.The paper discusses and studies the administrative anomie of the government in the specific process of land acquisition in order to standardize the conduct of government in land expropriation.
