民意具有法律民意与公众意见、公开民意与潜隐民意分型。借由权力部门和媒体、公众、学者意见构筑了民意表达二维构造。在静态层面,民意表达又具有直观性与非专业性、倾向性与流动性、广泛性与非组织性的特质。在民意表达过程中,公众表达自由与当事人正当权益、独立性司法与结构性诉讼、法律发展动因与非制度化表达恣意是其潜藏着的矛盾。要改变这些现状,司法部门应及时发布案情资讯,在改造程序化制度装置基础上,畅通民意表达渠道。

Public opinion includes legal public opinion and public opinion,overt opinions and covert opinions.The two-dimensional structure of the expression of public opinion is based upon authority,media,the public and the suggestions of scholars.Statically,public opinion takes on intuitiveness and non-professionalism,tendency and fluidity,universality and non-organizationality.In the process of the expression of public opinion,contradiction may lurk under public expression freedom and the parties’ legitimate rights,independent judicature and structural litigation,cause of law development and recklessness of deregulation expression.To change the current situation,judicial branches should announce some information about the case in time and smooth to the public through remolding the procedure structure.
