On the Status of Perpetrator in Common Crime

实行犯是直接实施犯罪构成客观要件的行为,在共同犯罪中处于主要地位。由于我国刑法在规定共同犯罪方面存在的不足,对实行犯的责任认定存在一定的偏差。在确定共同犯罪参加者的责任时,实行犯应当一概的作为主犯来看待,这样做既符合实行犯的应有之义,又遵守了罪刑法定原则与罪刑相适应原则的严格要求。

Perpetrator implements the objective elements constituting a crime who is at the main position in common crime.Because of the defects in the Penal Code,there is a certain deviation in the punishment of perpetrator.When punishing the perpetrator,we should view perpetrator as the principal in common crime all the time.Only we conduct as above can we say that we comply with the principle of legality and that the principle of crime fits punishment.
