摘要
《劳动合同法》正式实施已过两年了,有关劳动合同法立法宗旨的争论一直就没有停止过。立法过程中"单保护"与"双保护"的激烈争论来源于对《劳动合同法》进行法域定位的不同思路,其实质在于《劳动合同法》的本质属性究竟是偏重于私法还是公法?此类问题的考量应更多地立足于社会中的"实然"而非理念上的"应然"。
two years have passed since'Labor Contract Law' was put into effect,and debate on the legislative purpose of the labor contract law has not stopped. The fierce debate on 'single protection' and 'double protection' in the legislative process is from the different ideas on the jurisdictions positioning of 'Contract Law' emphasizes on the private or public law? Consideration of such issues should be more based on the 'is' of society,not the 'ought' of concept.
