我国人民监督员制度存在一些不完善之处,其中作为基础性环节的选任机制是关键所在,有必要在理论上予以厘清,在制度上予以完善。在人民监督员的任职资格上,应当建立大众化和专业化并存的二元制结构。在人民监督员选任范围上,应当在以人大代表、政协委员为多数的前提下,广泛吸收其他社会群体参加。在人民监督员的选任程序上,应当建立以人大常委会为主导的确认模式。
