论网络犯罪的“非对称侦查”

随着网络越来越普及,网络犯罪也以几何倍数增长。目前我国网络犯罪案件的侦查面临困境:一方面是犯罪主体反侦查能力增强,导致侦查难度加大;另一方面是侦查机关自身的侦查能力不足,导致对网络犯罪打击不力。侦查能力与反侦查能力的此消彼长呼吁新的侦查模式诞生。网络犯罪的"非对称侦查",以建立资源占有上的绝对优势为核心,以整合现有资源配置扬长避短为补强,对网络犯罪实施不容还手的打击,这将大大提高网络犯罪案件的侦查效率。在整个过程中,"信息一体化"是构建整个"非对称侦查"模式的基石。

With the popularity of the internet, cyber crime is growing at a tremendous speed. Current- ly, the investigation about the cyber crime faces two problems： one is that the anti-detective capability of criminals is growing, increasing the difficulty of the investigation;The other is that the abilities of the in- vestigation department can not crack down on the cyber crime effectively. That leads to the emergence of new crime investigation mode. The asymmetric investigation of cyber crime, centering on establishing ab- solute advantage for resources possession, emphasizing using the existing resources and striving for superi- or position, will powerfully crack down on the cyber crime and greatly improve the efficiency of the cyber crime investigation. In the whole process, information integration is the foundation of establishing asym- metric investigation.
