农民工欠薪问题在刑事立法中的思考

Reflection on the problem of peasant workers’wage default in the criminal legislation

针对目前普遍存在的企业中农民工欠薪问题,采用举证分析法,通过对农民工欠薪问题在刑事立法上的必然性分析,提出农民工欠薪行为应该纳入刑法调整,应当在《中华人民共和国刑法》第五章侵犯财产权中增设故意欠薪罪等措施,以此有效遏制和预防农民工欠薪行为,为保护农民工的合法权益,维护社会稳定,促进经济发展。

In view of the wage default problem among the peasant workers’in the enterprise,the author use the method of evidence analysis.Through the analysis of the inevitability in criminal legislation in the behavior of peasant workers wage default,the behavior of peasant workers wage default should be incorporated into the criminal law.The wage default offence should be added to the criminal law of the fifth chapter of property torts which can stop and prevent the behavior of peasant workers wage default,so as to protect the legitimate rights of peasant workers’safeguard social stability and promote economic development.
