我国农地征用过程中出现政策执行偏差的原因及矫正

Reasons for Deviation of Implementing Policies in the Course of Expropriating Rural Land and Its Redressing

在我国农地征用过程中,国家的发展目标和相关利益群体的期望最终能否有效的契合,从一定意义上讲,有赖于土地政策的有效执行。而现实中,却存在着农地征占、农地补偿、农地流转、农地听证等方面的政策执行偏差。我国农地征用政策出现偏差的原因主要包括:农地征用制度本身的模糊性造成的地权主体的缺失,中央和地方之间的利益目标差异,以及利益集团对政策过程的影响。要解决政策执行偏差,就必须从明确与农地相关的法律制度、确定地权主体、完善土地税收系统、约束寻租行为等方面入手,加大整治及监管力度。

In the course of expropriating land in our country,an effective coincidence between the national objectives of development and expectation of related interests groups depends in a sense on effective implementation of land policies.In reality,there are defects in implementing land policies when expropriating,compensating for,circulating and holding the hearing on rural land.To correct such defects in implementing land policies,laws and regulations concerning rural land should be highlighted,the subject of land right should be determined,the system of land taxation should be completed,the conduct of hiring land should restricted and governance and supervision of land use should be strengthened.
