农地征收中生态价值补偿法律问题探析

Investigation and Analysis of Legal Problems about Ecological Value Compensation in Farmland Expropriation

土地征收补偿应当是对被征收土地价值或功能的完全补偿。目前,我国农地征收制度存在补偿范围过窄、补偿标准不合理等问题,特别是征收中缺少对农地生态价值的补偿,导致农地征收价格偏低。应当将生态补偿纳入农地征收的范围,并科学量化农地的生态价值、合理确定农地生态价值补偿的标准、公平分配农地生态价值补偿收益,以完善我国农地征收制度。

Compensation for land expropriation should fully cover the value or function of the expropriated land. At present, in China＇ s farmland expropriation system, compensation range is narrow, compensation standards unreasonable, and especially, there is no compensation for ecological value of farmland, which leads to low price for the expropriated land. Therefore, it＇ s important to add ecological compensation into farmland expropriation, assess ecological value of farmland scientifically in quantitative approach, set reasonable compensation standards for farmland ecological value and distribute farm.land ecological value compensation income equitably to improve China＇ s farmland expropriation system.
