以人为本与解释理念的探究

People Oriented and the Ideas of Legal Interpretation

法律解释的理念是与法律价值相联系的理论问题,属于司法意识形态的内容。在解释法律的过程中究竟是以人为本、还是以法为本、抑或以权为本,对法律解释结果有重大的影响。以法为本是与严格法治相适应的,追求的是法律秩序;以权为本是与管理法治相适应的,达到的是方便管理和威权秩序;以人为本是与和谐法治相适应的,理想目标是自由法治。但实际的法律解释过程,是法律、权力、权利、价值、文化等综合因素在起作用。以法为本应该是我们目前应该奉行的司法理念,以人为本是我们下一步追求的目标。

The ideas of legal interpretation are theoretical issues connected to legal value in the judicial ideology. In legal interpretation,people oriented,law oriented or power oriented is very influential to interpretation results. Law oriented is connected to strict rule of law ,in pursuit of legal order;power oriented is related to administration rule of law for supervision and authority ;people oriented is connected to harmonious rule of law ,whose goal is free rule of law . However,the practical process of legal interpretation is combined with law,power,rights,value,culture . We should insist on the idea of law oriented for now,with the people oriented as the next step.
