摘要
为有效保障公民的受教育权,分析了公民受教育权被侵犯的成因,以及当前受教育权法律救济途径的不足,提出应完善学校内部及教育行政部门处理学生及学生申诉的有关规定、完善司法程序、充分利用现行法律的相关条款、完善相应的实体法,以保证公民受教育权的切实实现。
The right to education is one of the most important rights for citizens.In order to protect citizens＇ right to education,universities and the administrative departments of education should perfect relevant regulations before dealing with the punishment of students,perfect judicial procedures,and take full advantage of the relevant clauses in the existing law.Factors which cause the infringement of citizens＇ right to education and imperfectness in legal remedies of citizens＇ right to education are analyzed in the paper.
