摘要
遗弃罪是传统型的犯罪,随着社会观念与人际关系的变迁,近年来出现了新型的遗弃行为,使我国遗弃罪立法面临新的挑战,传统的遗弃罪规定不能有效地规制现实生活中的各种遗弃行为,基于此拟从法学实践出发重构遗弃罪的主体要件。
The crime of abandonment is a kind of traditional crime.As the change of social concept and relationships the new abandonment behavior appeared in recent years caused the new challenge.The traditional rules about abandonment crime can not restrain kinds of abandonment behaviors in real life;based on this,this article will restructure the body of abandonment crime.
