摘要
我国法学本科实践教学始终存在"形式化"现象,这种现象之所以存在,首先是因为我国法学本科课程设置机制具有明显的理论印记,限制了高校自主开展法学教育的空间;其次是因为法学教师在业绩考评和职称评审机制的作用下偏爱法学理论的教学和研究,使得他们缺乏开展实践教学的能力和动力;再次是因为法学本科生在成绩评定机制的压力下注重法学理论的学习,使得他们对法学实践教学缺乏足够的兴趣。
"Formalization" always exists in law practice teaching in China.There are three reasons.Firstly,our undergraduate law curriculum mechanism has a significant theoretical mark which limits the autonomy of colleges and universities to carry out legal education space;Secondly,teachers of law so prefer for teaching and research law theory under the performance appraisal and title review mechanism that they lack the practical teaching ability and motivation;Thirdly,the law undergraduates focus on law theory under the pressure of the performance evaluation mechanisms,this makes them lack of sufficient interest in law practice teaching.
