论我国商业秘密保护法律制度的完善

On the Improvement of Legal System of Business Secret Protection in China

我国商业秘密保护的法律体系已初步形成,但是,由于立法经验和立法技术的不足,经济发展水平不高,导致商业秘密保护存在界定不够准确、配套制度建设散乱、严密性和科学性较差等严重缺陷,对权利人合法权益保护的作用难以发挥。对比国内外立法的差异,借鉴和引入消费者权益保护法的惩罚赔偿金制度,构建全新、独立的商业秘密保护制度体系,以加强对权利人合法权益的保护,促进与国际接轨。

The legal system of business secret protection in China has been formed initially,but the dificiency of legislation experience and technology and a relatively low level of economic development lead to some serious drawbacks in legislation of business secret protection and having less function for obligees＇ legal rights protection.On the whole,the business secret limits insufficiently are accurate,the necessary system construction is scattered in disorder,hermeticness and the scientific nature are bad.Making contrasts of the domestic and foreign legislations,this paper reveals business secret protection legal framework malpractice,and proposes an introduction of the penalty indemnity system for consumer rights and interests protection,construction of a brand-new,independent business secret protection institutional framework.
