知识产权已越来越受重视,但知识产权制度的实施并未取得预期的效果。制度不完善、人们的知识产权意识淡薄是知识产权制度实施绩效不佳的重要原因,但知识产权制度实施绩效不佳的深层原因却在于利益问题。利益是知识产权制度产生、发展以及实施中存在问题的根本原因。只有从利益角度出发,完善知识产权制度,利用利益手段,协调和平衡知识产权制度实施中涉及的利益相关者的利益,才能提高公众的知识产权意识,提高知识产权制度实施的绩效。

Intellectual property rights have become increasingly valued,but the implementation of the intellectual property system has not achieved expected effect.The imperfect system and poor awareness of intellectual property rights are important reasons for the poor performance of implementation of intellectual property system.However,the fundamental reason lies in the matter of interests.Interests are the causes of production,development and problems arising during implementation of intellectual property system.Only by taking the interests seriously,improving the intellectual property system,using the means of interests to coordinate and balance the benefits of stakeholders involved in the implementation of intellectual property system,can we enhance public awareness of intellectual property rights and improve the performance of the implementation of the intellectual property system.
