《药品管理法》赋予了卫生行政部门行政司法裁决权。本文运用行政法和民法理论阐述了运用该项权能的程序和原则，指出行使该项权能的注意事项和完善卫生行政司法裁决权的建议。

Health administrative departments have the judicious powers according to the Drug Administration Law. This paper made a discussion of the application of judicious powers on the basis of the general principles of the Civil Law and the Administrative Law. Some suggestions are offered to perfect the judicial powers in health administration law.
