民国时期新疆公司法律制度初探

On Corporate Law in Xinjiang During the Period of Republic of China

民国时期新疆接受南京国民政府法统,逐步建立了包括公司法在内的近代法律体系,催生了新疆近代公司企业。由于社会发展、经济环境,文化氛围不同,结果形式上虽然具备了公司近代法律框架,但其实际上却没有发挥法律规范的作用。文章运用实证的方法,通过对两家新疆近代企业的具体分析,对当时新疆公司法律制度的实施和影响进行探究。

During the period of Republic of China, Xinjiang province gradually developed the modern law system including Corporat Law. However, the Law was twisted and wrenched since the enormous difference between China and the western in social history, val- ues and economic and culture environment. This paper analyzes the practice and influence of the Corporate Law by an empirica study of two companies in Xinjiang province during the period of Republic of China.
