我国网络公众理性化司法参与——语境、问题及建构路径

Cyber-public's Rational Participation in Jurisdiction in China——Context,Problems and Means of Construction

网络公众参与司法运作过程已经成为当今司法民主化进程的必然要求,促进理性化的网络公众司法参与更是中国司法现代化进程中的重大课题。在网络公众司法参与现实中,由于司法机关与网络公众间缺乏有效的双向互动关系、司法运作过程缺乏应有的透明度及司法机关没有建立有效的司法网络回应平台等问题,使网络公众司法参与理性化建构陷入困境。要实现司法民主化进程中网络公众参与的理性化建构,应当通过司法机关与网络公众建构有序参与共识的体验过程,建立透明的司法运作机制,引导网络公众司法参与行为的有效转化。

Cyber-public＇s participation has been an inevitable requirement for the democratic process of jurisdiction,and the acceleration of cyber-public＇s participation in jurisdiction rationally is a major issue in the modern process of China＇s jurisdiction. For the lack of effective two-way interactive mechanism, necessary publicity of judicial process and judicial feedback platform set up by judicial organs, the construction of cyber-public＇s rational participation in jurisdiction has confronted with dilemma. In order to realize the rational construction of cyber public＇s participation in judicial process,judicial organ shall set up an orderly participation process for cyber-public, formulate a transparent judicial operation mechanism,and promote the effective realization of cyber public＇s participation in jurisdiction.
