摘要
随着我国高等学校人事制度从传统的任命制向聘任制转变,高校与教师之间的纠纷呈日益增多的态势。高等学校与教师之间的法律关系决定了双方发生纠纷时,教师往往处于相对弱势的地位,教师权利被侵犯的事件屡屡发生,极大地影响了教师积极性的发挥。因此需要引入一种具有专业性、中立性和综合性的纠纷解决机制——教育仲裁。
With the shift from traditional designation system to appointment system in terms of college personnel in institutions of higher learning, disputes between colleges and teachers are on the increase. When disputes arise, the legal relationship between schools and teachers have always put teachers at a comparative disadvantage so that teachers' rights have been infringed upon, which greatly affecting teachers' initiative. The article puts forward edu- cation arbitration, which introduces some specialized, comprehensive and neutral legal remedies to resolve disputes.
