Legal Principle Analysis of the Extermination System of Juveniles’ Criminal Stain

未成年人刑事污点消灭制度,是指曾经受过有罪宣告或者被判处刑罚的未成年人,在具备法定条件时,由法定机关注销其有罪宣告或者处刑记录的制度,即被视为未受过刑事处分,成为零犯罪记录。未成年人刑事污点消灭制度有其存在的必要性、合法性和合理性。因此,我国应尽快建立未成年人刑事污点消灭制度,健全我国法律体系,为那些曾经失足的未成年人创造一个平等、关爱、信任的社会环境,以减少和杜绝他们重新犯罪,帮助他们重新扬起生活的风帆,成为对社会有用的人。

The extermination system of juveniles’ criminal stain refers to a system which, according to law, can exterminate the juveniles’ criminal stain who once had been declared guilty or sentenced, and can give such juveniles zero criminal record. The system has its necessity, legitimacy and rationality. Therefore, our country should establish the system to perfect the legal system, creat an equal, loving and trusting society for those juvniles who had been commited a crime, and finally help them become confident and become useful to our society.
