摘要
目前,随着我国城市住房制度改革的深入进行,建筑物区分所有权的情形普遍存在,现行法律法规也有相应的规定。但是对于建筑物区分所有权中共有权的性质仍存在理论上的争论,对于该共有权的行使也有不同的认识。对于以上两个问题的澄清有助于解决我国越来越多的有关建筑物共有权的纠纷。
At present, with the housing system deeply reforming in our cities, the issues on distinguishing the property of buildings exist widely, which makes the existing laws and regulations changed correspondingly. But as for the nature of the common right of the condominium ownership, there still exist some debates, and to the implement of the common right, there are also different understandings. Therefore, it is helpful to make clear the two problems to solve more relevant disputes on buildings ownership in our country.
