摘要
财产权纠纷是指有关当事人对财产所有权归属而产生的争议。财产权纠纷失范是指有关当事人在财产权归属争执中使用非道德化的手段,致使规范丧失了调节行为的能力。自上世纪90年代开始,我国民办高校财产权纠纷失范逐渐成为民办高等教育发展中的突出问题。本文运用默顿的失范理论,解读了在民办高校财产权纠纷过程中,参与学校财产权的内部治理、教育行政管理和司法救济各项活动的举办人、办学人、行政官员和法官的行为和动机,分析了民办高校财产权纠纷过程中的失范和越轨行为,并认为教育行政管理中存在的诸多问题是导致民办高校财产权纠纷失范的直接原因,同时指出,失范的根源在于文化价值内在矛盾所导致的主观价值标准冲突,即人们追求权力与金钱成功的文化价值与意识形态观念上的教育不以营利为目的之间的冲突。
Disputes over property rights refers to the dispute among the relevant parties who should own property fights, Property disputes anomie refers to the relevant parties in the dispute over property ownership who employ the means of demoralization, and norms losing the ability to regulate. Since 1990s, the anomie of disputes over property fights has become the highlight in the development of private higher education. This study appeals to Anomie Theory to analyze behaviour and motives of school sponsors, school founders, officials and judges who are involved in various events related to the internal property rights administration of private colleges, the administrative management over education and the judicial remedy. After studying anomie and illegal acts, this article believes that the anomie in private higher education is greatly influenced by chaotic management on education, and its roots are in the conflict of subjective values caused by the internal contradiction among different cultural values, i.e. the conflict between the cultural values that regard the possession of power and richness as success and the ideology that advocates non-profit education.
