我国量刑的合理性与规范性

The Rationality and Normalization of Punishment

长期以来,我国量刑活动中存在以下三大问题:量刑偏差、量刑失衡、量刑程序与定罪程序的混淆。通过借鉴美国量刑改革的一些做法,提出保障我国量刑活动实现合理性与规范性要求的建议:修改和完善我国的刑事法律法规;制定中国式的规范量刑指导意见;改善法官传统的报应主义刑罚观;提高审判人员的综合素质;正确处理好"严打"刑事政策与法律规范之间的关系,为保障我国司法审判人员作到量刑公正,最终实现刑事正义的价值追求。

For a long time,punishment activities in China have the following three major issues：punishment deviation,the imbalance of punishment,the confusion of the punishment procedure and the conviction procedure.This paper uses some experience of America＇s reform of the punishment practices for reference,and proposes some suggestions on realizing rational and normative punishment activities,such as revising and perfecting China＇s criminal laws and regula-tions,formulating sinotype normative punishment guidance,changing judges＇ traditional and retributive opinion about punishment,improving the overall quality of judges and correctly handling the relationship between the ＂strike hard＂ criminal policy and legal norms,in order to guarantee the judges＇ fair sentence and even realize criminal justice.
