摘要
非法控制性是黑社会性质组织的本质特征。在司法实践中,应该认真分析并严格地把握立法解释对非法控制性特征的规定。黑社会性质组织的非法控制是黑社会性质组织成立所需其他要素有机结合的效果体现。只有认真把握黑社会性质组织的非法控制性特征才能准确地认定及打击黑社会性质组织。
The illegal control is the essential characteristic of gangland organizations.In judicial practice,we should analyze and grasp the legislative explanation on the illegal control.The illegal control of gangland organizations is the embodiment of the organic combination of the other elements for the foundation of gangland organizations.Only when we master the illegal control characteristic of gangland organizations,can we accurately identify and crack down gangland organizations.
