摘要
追续权制度的产生因符合公平正义的价值取向而获得理论合理性基础。同时庞大的艺术职业者群体的社会需求奠定了追续权制度的现实合理性基础。艺术作品与其他一般作品的价值实现形式的差异及其内涵的人身属性进一步揭示了该项制度的制度合理性基础。英美法系国家虽恪守权利穷竭原则,但现实的社会需求又迫使其在司法实践中间接地认可了这项制度,因而可以说追续权制度成为著作权立法的必然选择。
The origin of Droit de Suite has the theoretic rational basis owing to its conformity with the value orientation of fairness and justice.At the same time,the social needs of a large amount of art professionals lay the realistic rational basis for it.The difference of value between artistic works and other common works and the personal attribute of the artistic works further reveal the system basis for Droit de Suite.Although the Anglo-American legal system sticks to the right exhaustion principle,the realistic needs compel it to indirectly accept the system in the judicial practice.Therefore the Droit de Suite system becomes the necessary choice of copyright legislation.
