从标签理论视角看社区矫正的基层推广

The Grass-roots Promotion of Community Correction View from The Labeling Theory

基于2003年社区矫正试点工作取得的较好成绩,我国开展了大规模的推广运动。截止2010年,全国已经有27个省市实行社区矫正的刑罚方式。就目前来看,社区矫正的现实运行遇到了一些问题,最关键的是社区力量没有真正发动起来,存在着上层政府热情推动和下层居民冷淡反映的反差现象。社区居民对矫正对象的不接纳成为影响社区矫正效果的最大原因。根据符号互动和标签理论,这有可能导致矫正对象的重新犯罪,进而为推广刑罚执行变更运动与和谐社会的建立带来了一定的阻碍。

For the good results Community Corrections in 2003 achieved,China launched a massive promotional campaign. Until 2010,about 27 provinces and municipalities have implemented community corrections as one kind of punishment measures.For now ,the community corrections operation has encountered some problems,the key is not really mobilized the community＇s efforts,within the situation that the passion of upper government to promoting community correction but the lower citizens.Community residents do not accept the correction ,and that is the biggest reason for the affection.According to symbolic interactionism and labeling theory,it may lead some criminal to commit a crime again.That may bring some obstacles to the project for the further changes of the punishment implementation and the establishment of a harmonious society.
