On Notice to Rectify Illegal Act in Prosecutorial Supervision on Civil Execution

纠正违法通知书是法律监督权在民事执行领域的体现,具有适用针对性、效力间接性、制度附从性的特征,在监督实务中发挥了积极作用。但目前存在法律规定不明确、缺少强制力、适用混乱等问题,学界对其研究也不足。有必要将纠正违法通知书制度的适用纳入法定程序,明确其适用范围、对象、内容、效力及程序。

The notice to rectify illegal act which plays an active role in the practice of prosecutorial supervision on civil execution has characteristics of application pertinence,efficacy indirection and institution accessory.But there still exist some problems of undefined legal rules,absence of enforcement power and chaotic application.And there is a paucity of research on this issue.It is necessary to bring its application into legal procedure,which means to make the applicable range,object,content,efficacy and procedure clear.
