排污权性质的理论选择

Theoretical Choice on the Nature of Emission Right

理论上对排污权性质的分析有多种,认为排污权属于环境役权、人役权、特殊用益物权、准物权、债权的都有,且各有其解释,无法断然否认其合理性。然而,当考虑到一项权利归入我国现有权利体系中的融合成本以及确认一项权利的性质对实践操作层面的影响时,把排污权确认为债权显然更具可行性,这就是对排污权性质的理论选择。在分析过程中,还对环境容量这一概念在法学分析中的误解进行了澄清。

Theoretically, there are several analyses on the nature of emission right, which is regarded as environmental servitude, personal servitude right, usufructuary right, quasi-- property right or creditor ＇ s right. All of them are reasonable to some extent and hard to be denied. However, considering the integration cost of blending a right with Chinese current system of rights and the influence of identifying the nature of a right on practical level, it is more feasible to take the emission right as creditor＇s right. This is the theoretical choice on the nature of emission right. In the process of analysis,this paper clarifies the misunderstanding of environmental capacity in legal analysis.
