On Mental Damage Compensation under British Contract Law

从英国合同法的基本原则出发,就英国合同法下精神损害赔偿原则做了深入的分析。结合法院的判例和最近合同法的新发展,从违约赔偿的性质、赔偿数额的计算、可预见性、对价和近因关系五个方面阐述了精神损害赔偿的可行性、必要性和合理性。同时也对英国合同法下精神损害赔偿的现状和发展做了陈述,认为在现今英国法律体制下,应该提倡精神损害赔偿的全面适用,而不是限制,这样才可以保证合同的有效订立和实施,才能使人们基于合同的期望得以实现。

This paper starts from the basic principles of British contract law,deeply analyzes the mental damage compensation principles, states the feasibility, necessity and reasonability of mental damage compensation through the new cases and development of the contract law and interprets the present status and development of mental damage under British contract law. It is believed that under the present British law system,mental damage compensation is supposed to be comprehensively applied instead of some kind of limitation. Thus,valid conclusion and complement of contract can be guaranteed and people＇s wish based on contract can be fulfilled.
