Procedural Control of Death Penalty

在从实体上废除死刑一时难以取得成效的情况下,从程序法上对死刑的适用进行严格的限制是一条更为理性和务实的道路。鉴于死刑案件的特殊性,立法上应当规定死刑案件的诉讼程序比普通的刑事案件程序更加严格。提高死刑案件的证明标准、完善死刑复核程序、完善死刑案件的再审程序、赋予被判处死刑的罪犯申请赦免的权利、规范死刑的执行程序,在特殊的情况下赋予被判处死刑立即执行的罪犯以减刑的权利,不但可以严格限制死刑在现阶段的适用,还可以为最终废除死刑进行观念上的过渡。

Since abolishing death penalty in substantive law can be achieved in a short term,strict control from procedural law on the application of death penalty is a more rational and pragmatic way.Given the special nature of capital punishment cases,legislation should ensure that they have more strict proceedings than regular criminal cases.Raising the standards of proof in capital cases,improving the review procedures of death penalty,polishing the re-trial procedures in capital cases,entitling criminals who are sentenced to death the right of pardon applications,regulating procedures of the implementation of the death penalty,giving criminals who are sentenced to immediate execution the right of application for commutation in exceptional circumstances,not only can strictly limit the application of the death penalty in contemporary time,but also can help the transition of concept of the eventual abolition of the death penalty.
