受教育权不仅是人权中一项重要的权利,而且也作为公民的基本权利与义务被列入我国宪法之中。权利的行使不是无界限的,基本权利的行使也是如此。基本权利的重要性使得对于它的限制应当采取更加谨慎的方式,法律保留原则就这样应运而生了。对于受教育权这样的宪法性基本权利的限制应当遵循法律保留原则,通过立法机关制定法律来进行限制,而不是通过部门规章来规定。

The educated right is not only an important right,but also as a citizen＇s basic rights and obligations to be placed on our constitution.Rights are not without boundaries,the fundamental right as well.The importance of fundamental rights makes it possible for its restrictions to adopt more prudent manner,the legal principle of reservations comes into being.The educated right should adhere to the legal principle of reservation,through restricting of legislation of the legislature,rather than by departmental regulations.
