服务型行政标准与司法审查标准——构建我国政府信息公开范围双重标准的思考

Service-oriented Administration Rule and Judicial Review Rule:An Study of the Information Disclosure Scope

公开范围是政府信息公开制度最核心的内容,也是最难以把握的内容。本文提出,应当区分并适用不同的标准判断政府信息公开范围,其一是"服务型行政标准",适用于解决"什么是可以公开的"问题;其二是"司法审查标准",适用于解决"什么是应当公开的"问题。针对不同情形确定并正确运用相应的判断标准,对于完善政府信息公开制度、充分保障公民知情权、正确裁判政府信息公开纠纷具有重要意义。

By what kind of rule can people identify whether some information could be disclosed to the public or someone specifically. ？ Could the same rule be used to judge the question whether the same information should be disclosed.＇？ According to this arti- cle, people should use different rules in different situations. ＂Service -oriented administration rule＂ is set up to solve the could - be question above, while ＂judicial review rule＂ for the should - be question. The misuse of those two rules will lead to the misidentification, thus will result in unwilling effect of the regulation of government information disclosure.
