摘要
仲裁作为一种起源于民间的替代性纠纷解决机制,能够有效预防和化解社会矛盾,其具有的意思自治性、中立性、民间性、快捷性等制度优点能够在社会管理中被借鉴和采用,从而促进管理理念转变,切实节约管理资源,实现社会管理创新。新形势下,我国仲裁制度要努力解决其发展中存在的问题,实现仲裁制度与社会管理的协同发展。
Arbitration, which originates in civilian, as one of alternative dispute resolve (ADR), can prevent and resolve social disputes effectively. Advantages of arbitration such as autonomous principle, neutrality, civilian and convenience can be adapted in so- cial management. In this way, arbitration can promote and motivate social management to establish new ideas, economize on management resources, and achieve the innovation of socia| management uhimate[y. Under the new situation, it is very im- portant to solve some problems in the developing process of arbitration in China, in order to accomplish the harmonious de- velopment between arbitration and social management.
