On Administrative Action

行政行为概念一直是行政法理论和实践的核心概念,但我国学术界的通说却使这一概念偏向了行政主体、行政权力和法律效果等个别属性,因而导致了在理论层面和现实层面的诸多问题。在我国建设法治政府、透明政府、责任政府的时代背景下,行政行为概念急需从结构上和内容上进行完善和更新。这一新的行政行为概念将有助于改善行政管理手段,在国家与公民之间构建新型的合作关系,同时也有助于完善行政诉讼受案范围制度及其未来的《行政程序法》的结构体系。

The concept of administrative action has always been a significant definition in both administration theory and practice.Because this concept emphasizes the administrative subject,administrative power and legal effect which leads to various problems in the areas of theory and practice,it is urgent to update and perfect the concept from its content and framework to suit with the background of building a transparent government,a government ruling by law and a responsibility-oriented government.The newly established concept will be helpful to improve administrative measures and set up cooperative relationship between state and citizen.Meanwhile,this concept will also be useful to improve the institution of administrative lawsuit scope and structural system of administrative procedure law in the future.
