透析征地农民权益保护的重点和难点

在社会变迁和经济结构转型的加速时期,土地征收为我国经济发展和城市化做出了很大贡献,但由于农村集体土地所有权主体缺位、监管缺失、公共利益界限模糊、农村集体农民成员权被架空、司法救济制度不完善等原因,征地中土地纠纷不断,乱象丛生;保障征地农民权益,理顺土地乱象,需要从完善农村集体土地出资人制度、严格公共利益、保障农民成员权等几方面多管齐下,才能使农民权益的保障落实到实处。

In the period of social change and economic transformation,land acquisition has made great contributions to China＇s economic development and urbanization.But because of the absence of rural collective-owned landownership,the lack of supervision,ambiguity of public interest,the aerial right of farmer members of rural collective,imperfect system of judicial relief and so on,land disputes continually occur.In order to protect member rights of landless farmers and avoid the occurrence of disputes,the several aspects must be improved quickly,for example,the investor＇s system of rural collective land,strict public interest,the protection system of the right of farmer members etc.
