依法治校是教育发展的必然要求。在法律视野下对高等学校学生管理制度进行创新,是高校依法治校的应有之义。当前,我国高校学生管理中存在法律意识淡薄、法律体系不够完善、权利救济不够健全等问题。要坚持育人为本,维护学生合法权益,建立健全学生管理的法律制度,完善学生管理的权利救济,以高校民主管理为基础实现学生管理法治化,使高校学生管理从主要依靠行政转变为依靠法律。

Managing school according to law is a necessary requirement for development of education. Innovating the college student management system in the legal perspective is the proper meaning of managing school according to law. At present, there＇ s weak legal sense in college student management, the imperfect legal system, and the unsound remedy system. Upholding people-centered education, maintaining students＇ lawful rights and interests, setting up and perfecting the management system, improving the rights remedy system of student management, make the legalization of student management on the base of democratic management, to manage school by law more than by administration.
