摘要
新《劳动合同法》对企业的劳动合同规范化提出了更高的要求,工作流程要更细致和严密,加大了企业的违法成本。能否顺利应对《劳动合同法》的新规定,将决定企业人力资源乃至整个企业的前途和命运。因此,如何解决好《劳动合同法》公布之初的劳资合同冲突问题,重新规范企业的劳动合同,化解企业与员工之间关于劳动合同的冲突和矛盾问题,促进整个企业在劳动合同方面规范、合理、合法,将是所有用工单位所必须面对的现实问题。本文阐述的是一个具有典型国企特点的房地产企业在应对新《劳动合同法》过程中,因为重新规范劳动合同而产生的一系列冲突事件和麻烦,案例中所发生的各种冲突以及遇到的各种情况都是比较典型的。
The new Labor Contract Law puts forward more stringent requirements for the standardization of the labor contract of enterprises. It will increase the default cost of the enterprises. Whether an enterprise can favorably apply the new prescript of the Labor Contract Law will determine the success and failure of the human resources department of the enterprise,which in turn impacts the prospect and destiny of the whole enterprise. Consequently,how to resolve labor conflicts after the issuing of the Labor Contract Law,redefines the labor contracting process of the enterprise. Eliminating the conflicts about the labor contract between enterprises and employees,and promoting standardization,reasonableness and legality for the labor contract of the whole enterprise will be real problems faced by all the enterprises. This paper illuminates a real estate enterprise,which has the character of a typical state-owned enterprise,on how to resolve a series of conflicting events and problems because of the labor contract redefinition. All the conflicting events and problems are very typical.
