高雄捷运项目的管理模式和适用法律

Management Mode and Applicable Law of the Kaohsiung Mass Rapid Transit Project

高雄捷运项目采用政府和公司联合投资的PPP管理模式,在计划和实施过程中出现了一系列的问题。论文陈述了高雄捷运项目管理模式的确定过程和适用法律的认定过程,分析了项目组织模式和合同结构;论证了项目的适用法律,分析了项目争议出现的原因。对于只有部分自偿能力、涉及政府和企业共同投资的基础设施项目,对于项目的管理模式、合同结构、监督机制等方面提出了改善措施。

A series of problems occurred in the planning and execution process of the Kaohsiung Mass Rapid Transit Project,which adopts Public Private Partnership（PPP） management mode.First,the decision making process of its management mode and applicable law were clarified.Secondly,its organization mode and contract structure were analyzed.Thirdly,the applicable law was demonstrated and the reasons for the disputable items were investigated.Finally,the improvement measures for project management mode,contract structure,and supervision mechanism were proposed for the infrastructure projects which are partially self-reimbursable and involve the investments from the government and companies.
