情谊活动中的侵权行为在生活中较为常见。为保护受害人的合法权益,应当赋予受害人以侵权损害赔偿请求权。情谊活动中的行为人采取了合理措施预防危险、制止危险或进行事后救助就可以认定为尽了必要的安全注意义务。同时,情谊侵权责任的归责原则只能适用于过错责任原则。
