摘要
性骚扰行为侵害的权益具有侵权法上的可救济性。侵权责任法确立的雇主责任和违反安全保障义务的责任,可以适用于职场性骚扰和公共场所性骚扰;但该法难以涵盖这些性骚扰行为的全部类型,需要与其他法律一起共同实现对性骚扰行为的规制。
The fights and interests that sexual harassment violates may have remedy according to the Tort Law. The employer responsibility that The Tort Law established and the responsibility that violates the safety control duty may be suitable in the workplace sexual harassment and the public- place sexual harassment. But this law is difiicult to cover all the types of sexual harassment. It needs to be exercised together with other laws to realize the treatment on sexual harassment behavior.
